Read these terms before submitting a commission brief. By commissioning the studio, you confirm you have read and agreed to all terms below.
The Artist reserves the right to refuse or cancel any commission that:
Exceeds current capacity.
Violates laws, platform policies, or ethical standards.
Involves hate speech, illegal content, or infringement of third-party rights.
The Artist is not responsible for how the artwork performs on any platform (e.g., Twitch, YouTube, VTuber software), nor for changes to platform rules, layouts, or monetization policies.
Payment: First-time clients must pay 100% upfront. Returning clients may discuss installment plans on a case-by-case basis. Work will not begin until payment is received.
Refund Policy: Refunds are issued only if the Artist cancels the commission. No refunds will be issued once the sketch has been approved or once the coloring/rendering stage has begun. No refunds will be issued after final delivery.
Disputes: Chargebacks or payment disputes filed after delivery constitute a critical violation of this agreement and result in immediate license termination.
Sketch Phase: Major edits regarding layout, perspective, and composition are strictly limited to the sketch approval phase.
Final Stage: Once the sketch is approved and the rendering/coloring phase begins, no major structural changes can be made. The final stage only supports 2-3 minor adjustments (e.g., small detail tweaks or slight color corrections).
Requests for major structural changes after sketch approval will require a completely new quote and timeline adjustment.
Full copyright remains with the Artist. The Client is purchasing usage rights only, not ownership (unless a Full Buyout is purchased).

Streaming & Content Creation: Unlimited use in live streams (Twitch, YouTube), VODs, and social media posts. Monetisation via ads, Super Chats, memberships, and subscriptions is fully permitted.
Layer Adjustments for OBS: Rearranging, toggling visibility, and independently adjusting individual PSD layers for dynamic OBS scenes. Delivery of source files grants modification access. It does not constitute copyright transfer.
Spotify Canvas & Platform Crops: Reformatting the environment to the required aspect ratio for Spotify Canvas, YouTube thumbnails, and social media headers.
Animation Loops: Using provided animated elements as an integral part of the environment backdrop across all approved platforms.
AI Training, NFTs & Generation: Using the artwork, or any internal layers, to train generative AI models, run image-to-image processing, or mint as NFTs/Blockchain assets. This restriction has no exceptions and survives license termination.
Asset Extraction: Extracting individual props or elements — e.g., a coffee mug, a lamp, a window — to use as standalone graphics, Twitch emotes, or separate products outside the context of the environment.
Resale & Redistribution: Selling the original files, PSDs, or as-is assets to third parties. The license is personal and non-transferable, unless a Full Buyout with sub-licensing rights is purchased.
Misrepresentation: Claiming authorship or creative credit for the artwork itself.
Licenses are subject to immediate termination upon critical breach of terms. Studio integrity and copyright enforcement are non-negotiable.
Grounds for immediate revocation:
Evidence that Minchan Machiko assets have been fed into AI-training models, used for image-to-image processing, or distributed for generative AI purposes.
Distribution of raw PSD files or source assets to third parties for resale.
Misrepresentation of authorship in a public or commercial context.
Upon termination:
The client must immediately cease all use of the assets on active broadcast channels, published games, and commercially available products.
No refund is issued for licenses revoked due to breach of terms.
The artist reserves the right to pursue legal remedies under applicable copyright law.
(Note: These clauses exist to protect both the studio’s intellectual property and the client’s legal standing. A client whose license is in good standing has nothing to fear from these terms.)
The Artist retains the right to display completed artwork for portfolio, website, social media, and promotional materials — unless a Full Buyout/NDA has been purchased. Clients who require full confidentiality may request a Privacy / No-Credit option prior to payment (+15% of base price). The Full Buyout tier includes full anonymity as standard.
All artworks are delivered digitally via a secure file transfer link. The Client is responsible for inspecting all files and layers upon receipt. Any missing or corrupted files must be reported within 7 days of delivery. The Artist’s responsibility is limited to providing the originally agreed files. No refunds will be issued for missing assets discovered after the inspection window.
The Client is responsible for maintaining their own backups of all received files. The Artist is not obligated to retain or recover project files after delivery.
Complimentary minor support may be provided for small layer adjustments for animation or simple color corrections (e.g., screen/monitor tones). This support is limited to minor tweaks, not guaranteed, and does not include redesigns or major revisions. Additional requests require a separate fee.
The Artist shall not be held liable for loss of income, views, or monetization resulting from use of the artwork; platform bans, demonetization, or policy changes enacted by third-party platforms; or third-party claims arising from the Client’s use of the artwork outside the stated license scope. Total liability shall not exceed the amount paid for the commission in question.
This agreement shall be governed by and interpreted under international copyright principles and the laws applicable to the Artist’s operating location. Any disputes shall be resolved through good-faith communication. If unresolved, legal action shall be brought only in the Artist’s jurisdiction.
